Legal news in reproduction

o Two years ago, Jan Balaz of Germany began a fight to bring his twin children home from India where they had been born to a surrogate. In Germany, surrogacy is illegal and that country was not allowing the children to be treated as citizens and therefore was keeping them out of the country. In March the Indian Supreme Court ordered India’s Central Adoption Resources Agency to make an exception and allow the German couple to adopt their own children in India. Once completed, Germany will have to recognize the adoption and admit the children. The process should be finalized in the next four months. It has been a grueling, international news piece bringing attention to the fact that many laws are not keeping up with surrogacy, much less international surrogacy, and making changes to accommodate the new ways families are created.

o There are new indications coming out of Florida that same sex couples will be allowed to adopt. In the last four years, there have been repeated attempts to abolish the 33 year old ban on gay adoption. The pending cases for gay couples who would like to adopt their foster children and for gay couples who want to adopt each other’s children have attracted attention from national media and many Hollywood stars.

o Many people find creative ways of funding infertility treatments. Police in Bennington, Vermont arrested a man for setting fire to his own house in order to collect insurance money to pay for his wife’s infertility treatments. The man has plead not guilty. In a delicious bit of irony, he is a volunteer with the local fire department.
